What Is ADA Title II?

ADA Title II is the civil-rights law that requires state and local governments to make their Information and Communication Technology (ICT) accessible to people with disabilities. This includes websites, web documents (like PDFs), mobile apps, video, audio, images, and online training. ADA Title II requires compliance with the WCAG 2.1 Level AA accessibility standards.

 

The U.S. Department of Justice (DOJ) issued the final rule on April 24, 2024, and it became effective June 24, 2024.

How Does It Apply to Me?

If you’re a public entity, your content and mobile apps must meet WCAG 2.1 AA accessibility standards. There are some narrow exceptions, including certain archived content, some pre-existing conventional documents, and some third-party content. 

When Do We Have to Comply?

Compliance deadlines depend on the population you serve as defined in the DOJ rule.

Public entities (not special districts) serving ≥ 50,000 people must comply by April 24, 2026.

​

Public entities serving < 50,000 people (or any special district government) must comply by April 26, 2027.​

Deadlines for Compliance

Statewide Entities

Statewide entities include executive agencies, statewide higher-ed systems and universities, statewide courts, and statewide public safety and health agencies that serve ≥ 50,000 people.

Deadline: April 24, 2026

Counties

The deadlines for counties depend on the population.​

Deadline:

  • April 24, 2026 for counties with a population ≥ 50,000

  • April 26, 2027 for counties with a population < 50,000

Cities/Municipalities

The deadlines for cities/municipalities depend on the population.​


Deadline:

  • April 24, 2026 for cities/municipalities with a population ≥ 50,000

  • April 26, 2027 for cities/municipalities with a population < 50,000

School Districts (Including Independent Districts)

The deadlines for school districts depend on the population. â€‹Follow the 50,000 population threshold of the jurisdiction served (most districts are county-based).


Deadline:

  • April 24, 2026 for those with a population ≥ 50,000

  • April 26, 2027 for those with a population < 50,000

Special District Governments

Special district governments include transit, water/sewer, airport/port, community improvement, and development authorities.

Deadline: April 26, 2027 regardless of population

FAQ's

What is “ICT”?
 

Information and Communication Technology. That includes websites, documents (like PDFs and forms), images, audio/video, mobile apps, and online training. 

 

Which standard applies to ADA Title II?
 

Web Content Accessibility Guidelines (WCAG) 2.1 Level AA accessibility standards applies for all ICT.

 

Are there any exceptions?
 

Yes, but they’re narrow (e.g., certain archived web content, some pre-existing conventional documents, some third-party content, certain pre-existing social media posts). Always document why an exception applies. 

 

Do third-party tools or vendor portals count?


If you present them as part of your services or embed them in your site/app, you are still responsible for accessibility or for offering an accessible alternative. Plan for accessible procurement.

 

Do universities count as “≥ 50,000”?
 

Public universities are treated as public entities serving the state. As such, they fall under the April 24, 2026 deadline.
